Golf Cart and Street Legal Cart Rental Agreement
This Agreement (“Agreement”) is entered into by and between Cary Cart Company, Inc. (“Lessor”) and the individual or entity renting a Golf Cart or Street Legal Cart (“Lessee”). The terms “renter” and “lessee” shall be used interchangeably and have the same meaning.
Definitions:
The term “Vehicle” refers to a Golf Cart or Street Legal Cart.
Drivers must be at least 16 years old and hold a valid driver’s license.
- Continuing Obligation:
Lessee grants Lessor the right to charge Lessee’s credit card for any charges, fines, or assessments imposed on Lessor arising from the operator’s acts or omissions during the lease period.
- Compliance with the Law:
Lessee agrees to abide by all State and local laws governing motor vehicles in North Carolina when operating the Vehicle on public streets and highways.
- Geographical Limitations:
The Vehicle shall be driven only within the designated area defined by law.
- Liability for Injury, Death, and Property:
Lessee assumes all liability for injury, death, or property damage resulting from the operation, use, or possession of the Vehicle and agrees to hold Lessor harmless from any related claims.
- Vehicle Return: Loss, Theft, Damage, or Destruction:
Lessee assumes all risks of damage, loss, or theft of the Vehicle and is responsible for repair costs. Lessee must notify Lessor immediately in case of loss, theft, destruction, or damage and return the Vehicle by the lease expiration to avoid additional charges.
- Assumption of Risk:
Lessee acknowledges the inherent dangers of operating the Vehicle in traffic and assumes the risk of injury or death, releasing Lessor from future claims.
- Default:
Lessee shall be in default if they fail to pay any sum when due or violate any lease promise. In default, the Vehicle shall be surrendered to the Lessor.
- No Refund:
No refund will be made for cancellation of reservation or vehicle malfunctions. The lessor’s sole responsibility is to repair/ replace the Vehicle.
- Insurance:
Lessee acknowledges liability insurance coverage on the golf cart and agrees to hold Lessor harmless for any damages or injuries sustained during the operation.
- Indemnification:
Lessee agrees to indemnify and hold Lessor harmless against claims, liabilities, costs, and expenses related to the Vehicle’s possession, use, maintenance, condition, or operation.
- Final Audit:
All charges are subject to a final audit. Lessee authorizes Lessor to process credit card vouchers for all charges, including damages and late fees.
Operation of Carts:
Street-legal cart and Golf Cart operation is restricted to the Lessee or designated driver.
Drivers must be 16 years of age and hold a valid driver’s license.
Passengers must wear seat belts in street-level carts.
Operators must comply with N.C. Highway Safety Regulations.
Street-legal cart drivers must prioritize safety for passengers, property, and the Vehicle.
Notification and Return:
In case of loss, theft, damage, or inoperability, the Lessee must notify Cary Cart Company, Inc. promptly at 910-457-7333.
Daily/weekly rentals must be returned by the close of business on the last day of rental to avoid additional charges.
Policy Agreement:
By selecting the policy agreement checkbox during checkout, Lessee agrees to the full terms of this policy.
Acknowledgment:
Lessee has read and agreed to the Terms of Service.
